george lucas的公司lucasfilm在英国法院最终输掉了关于暴风兵道具版权纠纷的官司。这个官司开始于lucasfilms起诉当年的道具设计师andrew ainsiworth，控告他在销售暴风兵盔甲的经营活动中侵犯了lucasfilms的权益。2006年lucasfilms在美国控告andrew的SDS公司胜诉，判决sds赔偿lucasfilms2000万美金，但是这一判决并没有影响英国法院引用英国法律时的最终意见，英国法院认为lucasfilms的道具并非艺术品，所以生产和销售复制品不在英国法律的版权保护范围之内。所以判决lucasfilms败诉。
这一判决使SDS可以继续生产和销售相关道具产品（不过从2006年开始他就没停过....），并且拒绝了美国高等法院在2006年的一切判决——英国公司虽然在美国有销售活动，但英国没有将法律管辖权拱手送给美国的义务。
但是判决还是警告了andrew不要藐视美国的版权法律，一切经营活动要符合当地的法律法规。（SDS大不了不在美国直销了）
每日电讯报的消息透露，lucasfilms并不打算认可这一判决，不日将上诉。

BBC News is reporting that George Lucas' company LucasFilm has lost a battle with the UK courts in regards to a copyright issue over Stormtrooper costumes. This all started when Lucas' company claimed props designer Andrew Ainsworth, who sells replica Star Wars costumes was breaching copyright law by creating original Stormtrooper suits and helmets and then selling them. The courts have now rejected this claim by Lucas stating that the helmets were not works of art and were therefore not covered by copyright law in the UK.
The decision allows Mr Ainsworth to continue producing the uniforms.
The court was upholding a ruling made last year by the High Court in the multimillion pound battle over the replica uniforms, which Mr Ainsworth sells online.
The judges also refused to enforce a $20 million (?12.4m) damages award Lucasfilm won against Mr Ainsworth in a US court in 2006, saying the prop designer's US sales were not significant enough to make him susceptible to US jurisdiction.
The judges in this case however warned Mr. Ainsworth that he was in violation of US copyright laws and warned him about trying to sell these in the United States.
Sources at the Daily Telegraph claim Mr Lucas intends to appeal the decision. |
